1. General Agreement

These Terms and Conditions govern the use of Your Lenz’s website and services. By using our website or engaging with us for our services, you acknowledge that you have read, understood, and agreed to be bound by these terms.

2. Services Provided

Your Lenz offers a variety of services, including but not limited to:

• Website design and development

• Branding and graphic design

• Digital marketing 

• Content creation and strategy

All services are subject to availability, and the details of each service will be outlined in a separate contract or agreement.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information for the projects.

• Ensure timely feedback, approvals, and responses to maintain project schedules.

• Be responsible for securing the rights to any content (text, images, etc.) you provide for use in your project.

• Follow all guidelines, deadlines, and payment schedules as outlined in the service agreement.

4. Payment Terms

• The payment for services will be agreed upon prior to the start of the project and outlined in the service agreement or invoice.

• Payments may be due upfront, in installments, or upon completion, depending on the service agreement.

• Your Lenz reserves the right to charge interest on late payments at a rate of 2% per month, or the maximum allowed by law, if payment is not received by the due date.

5. Intellectual Property

• All intellectual property, including logos, graphics, designs, and content created by Your Lenz for your project, will remain the property of Your Lenz until payment is received in full.

• Upon full payment, the intellectual property rights are transferred to you, the client. However, Your Lenz retains the right to showcase work in its portfolio and marketing materials.

6. Confidentiality

Your Lenz respects the confidentiality of all client information. Any sensitive or proprietary information provided to us will be treated as confidential and will not be shared with third parties, except as required by law or client permission.

7. Limitation of Liability

Your Lenz is not responsible for any indirect, incidental, or consequential damages arising from the use of our services. This includes, but is not limited to, any financial losses, lost profits, or reputational damage. The total liability of Your Lenz in relation to any project is limited to the amount paid by the client for the specific services rendered.

8. Indemnification

You agree to indemnify, defend, and hold harmless Your Lenz from any and all claims, losses, damages, liabilities, costs, and expenses arising from your use of our services, including any third-party claims related to the content or materials you provide.

9. Termination of Services

Either party may terminate the agreement with written notice. If the client terminates the contract before completion of the project, the client is required to pay for the work completed up to that point. Your Lenz reserves the right to terminate services if the client fails to meet their obligations under these Terms and Conditions.

10. Changes to Terms and Conditions

Your Lenz reserves the right to update or change these Terms and Conditions at any time. Any changes will be posted on this page, and your continued use of our services after such changes will constitute your acceptance of the updated terms.

11. Governing Law

These Terms and Conditions are governed by the laws of South Africa. Any disputes arising from the use of our services will be resolved in the court.
